Stop Sign Obscured

Milpitas, CA: (Apr-09-08) Salvatore J. Serio, a San Jose man, brought a lawsuit against the city of Milpitas, Eduardo Mosqueda, a Milpitas Public Works Department employee, and the City of San Jose, claiming that he was seriously injured after a city-owned Ford truck driven by Mosqueda slammed into him. The suit sought damages in the amount of $100,000 for pain and suffering caused by the accident.

Serio alleged that on Oct. 10, 2006, he was riding a Harley-Davidson motorcycle westbound on Jackson Avenue in San Jose at North 13th Street, when he collided with the truck, which failed to stop for a stop sign at the intersection. As a result of the crash, the suit stated that Serio sustained injuries and damages. The City of San Jose was also named as a defendant, as an overgrown tree obscured a North 13th Street stop sign the Milpitas worker did not see.

Reports state that the case has reached a settlement, in which the city of Milpitas and the city of San Jose collectively agreed to pay $28,500 to resolve the personal injury lawsuit. Officials stated that the settlement agreement was reached as the result of mediation hearings that were held in Superior Court. [MILPITAS POST: CRASH SETTLEMENT REACHED]
