Napa Valley, CA: (Apr-09-08) A lawsuit was filed against Napa County Supervisor Harold Moskowite, alleging that he assigned two parties the right to use the same space in a winery near Lake Berryessa. The suit stemmed from a dispute over space Moskowite rented to Richard "Bart" Barthelemy, for his St. Barthelemy label, and simultaneously to Moss Creek Winery, operated by Moskowite's son, George, and daughter-in-law Anne.
Sources close to the case stated that the original lawsuit filed was for breach of contract and fraud. Four days after lawyers selected a jury for what was scheduled to be a 10-day trial, the two sides reached a settlement. As part of the settlement agreement, Moskowite is ordered to pay $300,000 to resolve the dispute. Apart from the monetary payout, Moskowite must make improvements to Moss Creek Winery, including installing a ventilation system for his wine caves.
