This is a settlement for the Trademark, Copyright, Patent lawsuit.
San Francisco, CA: (Apr-14-08) Diomed Holdings Inc., a currently bankrupt company, brought charges against AngioDynamics Inc., alleging that the company infringed on its patents. The suit claimed that the infringement was over varicose vein laser treatment technology. Sources stated that the two parties resolved the lawsuit by entering into a settlement agreement, in which AngioDynamics agreed to pay $7 million to Diomed.
As a result of that settlement, Hercules Technology Growth Capital Inc. announced that it will receive repayment of principal on the company's debt financing to Diomed Holdings Inc., which is currently in Chapter 11 reorganization. Hercules officials claimed that of the $7 million payout, Diomed will give $6 million to repay the outstanding loan balance to Hercules under an order approved by the US Court of Bankruptcy for the District of Massachusetts.
