Genotyping Patent
This is a settlement for the Trademark, Copyright, Patent lawsuit.
Brussels, Belgium: (Apr-14-08) Innogenetics, a Belgian biopharmaceutical group, brought a lawsuit against Abbott Laboratories, a US based group, alleging patent infringement. The 2005 lawsuit, filed in US district Court claimed that Abbott infringed the biopharmaceutical group's patented Hepatitis C virus genotyping technology. In recent developments in the suit, company officials announced that in January 2008, the United States Court of Appeals for the Federal Circuit upheld the US District Court's ruling that Abbott infringed on Innogenetics's patents, and ordered the company to pay Innogenetics damages for infringement. The judgment also imposed sanctions as a result of Abbott making alleged baseless claims against Innogenetics. Under the terms of the settlement agreement, Abbott will pay Innogenetics $9.5 million to resolve the lawsuit. Additionally, Innogenetics will also receive undisclosed royalties for each hepatitis C test sold by Abbott worldwide during the patent term.
