Illegal Driver Rewarded

Niagara County, NY: (Apr-16-08) Kenneth J.S. Martin, 26, a Wilson man, brought a lawsuit against Niagara County, after he sustained injuries in a collision with a Niagara County sheriff's patrol car in 2003. The suit claimed that Martin suffered a head injury when his all-terrain vehicle was struck by the patrol car of Deputy Matthew Cipoletti about 3 a.m. Aug. 28, 2003, on New Road in Wilson. In its defense, the Sheriff's Office claimed that Martin was not wearing a helmet. It said that Martin slammed on the brakes and was struck by the front corner of the patrol car as Cipoletti swerved in a bid to avoid contact.

Records of the incident show that the ATV flipped over four times injuring Martin. He was admitted in Erie County Medical Center for four weeks. As a result of the injuries, he was left unable to work because of double vision, short-term memory loss and other symptoms. Court papers reveal that Wilson Town Justice George R. Berger convicted Martin of not having his headlight on, driving an ATV on the highway, not wearing a helmet, not having license plates and driving an unregistered ATV. Martin was acquitted on charges of failure to keep right and driving without insurance. He paid $465 in fines and surcharges.

In a settlement reached with the county, sources confirmed that the Wilson man is being paid $305,000 to resolve the personal injury lawsuit. [THE BUFFALO NEWS: SETTLEMENT APPROVED IN ATV COLLISION]
