Landslide Damage
Marin County, CA: (Apr-21-08) Four Novato families brought lawsuits against Marin County and the Marinwood Community Services District, claiming that a fire road above them caused or contributed to a massive mudslide that inundated their homes during the violent storm of Dec. 31, 2005. The families whose Pacheco Valle homes were damaged in a landslide included Dennis and Karen Neeley, Joseph and Anne Loera, Jeffrey and Jeanne Zane, and Orlindo and Barbara Barsetti. The suit claimed that the damage was caused after more than 2,000 cubic yards of mud and debris came down from above, destroying windows, driveways, decking, a garage wall and a home office. No injuries were reported.
As part of a settlement agreement entered into by both sides, the four families will jointly receive $525,000 to repair their properties. The deal stated that blame was not established, and that while some portions of the road are county land and others part of the Marinwood district, the origin of the slide was not determined. The settlement stipulated that the portion of the road that was wiped away is on Marinwood land and will be repaired.
