Tidal Water Dredging
Baltimore, MD: (Apr-22-08) The Maryland Department of the Environment (MDE) brought a lawsuit against Maryland Marina Properties, LLC, of Charles County, claiming that the company dredged tidal waters without an authorization, which was a violation of state law. State officials said that Maryland law (Title 16) requires that MDE be notified of any work conducted in tidal wetlands and waterways of the State before starting any work. The state will then issue a license or give approvals authorizing the work to be conducted as appropriate. The suit against Maryland Marina Properties violated the premise that performing work in tidal wetlands needs the permission of MDE to ensure that an assessment of the impact to the tidal waters and the associated resources is made before the work is performed and that any impacts are minimized. As part of a settlement reached with the company, Maryland Marina Properties agreed to pay $7,500 to resolve allegations.
