Death by Taser
Lubbock, TX: (Apr-30-08) The family of Juan Nunez III, a man who died in April 2006 after an altercation with a Lubbock police officer, brought a wrongful death lawsuit against the City of Lubbock and Officer Matt Doherty. The suit stated that Doherty used excessive force and that the police department's faulty Taser Usage Policy is to blame for Nunez's death. Federal records indicate that Doherty tased Nunez four times within 40 seconds. The department and the officer claimed that the action was reasonable and according to the officer's training. The medical examiner ruled alcohol and a head injury from a fall caused by the tasing contributed to Nunez's death.
As part of a settlement agreement reached in the case, the City of Lubbock, Doherty, and the family of Nunez resolved the case with an undisclosed payout.
