Safety Violations
Milwaukee, WI: (May-05-08) The Occupational Safety and Health Administration (OSHA) brought charges against A. W. Oaks & Sons, a Racine construction company, over a December 2007 incident, in which a trench collapsed killing a Racine man. The federal agency cited the company for three safety violations. Sources stated that a settlement was reached by the two sides in which, A. W. Oaks & Sons agreed to a $13,300 payout to the federal body to resolve allegations.
Sources stated that the payout is $3,500 less than it was originally cited in April 2008. OSHA spokespersons said that under the deal, it dropped the citation that stated an adequate person did not inspect the trenches before work started and throughout the shift. The company brought in evidence that showed the training and experience of the person who inspected the trench, stating that it was sufficient. OSHA said that as part of the agreement, the company will have to pay for the other three citations that state, that the protective system was inadequate; vital information was not onsite; and employees dug too deep underground.
