Portland, OR: (May-06-08) Adidas America Inc. brought a trademark infringement lawsuit against Payless Shoesource Inc., alleging that the company used Adidas America Inc.'s three-stripe trademark and shoe styles. In a recent development in the case, spokespersons announced that the suit had been resolved after a federal jury in Portland ordered Payless Shoesource Inc. to pay Adidas America Inc. $304.6 million for infringing on its trademark and shoe styles.
Sources stated that the deal include $30.6 million in actual damages, $137 million in punitive damages and $137 million in Payless profits. Topeka, KS based Collective Brands Inc., which operates the Payless chain, stated that the settlement was excessive and unjustified, and that it will ask the court to set the verdict aside or take all necessary steps to overturn it. Market sources stated that this is the largest award ever in a trademark-infringement case, surpassing a $143 million judgment in 1999 over an antibiotic.
