Fatal Car Crash
This is a settlement for the Car Accidents (National) lawsuit.
Portland, ME: (May-05-08) Wilmot Lewis, husband of 78-year-old Ethel, brought a wrongful death lawsuit against Lori Marston, the driver whose minivan hit Ethel Lewis, killing her. Records of the incident show that the crash initially described by the police to be a hit-and-run, but prosecutors later determined that Marston did stop and render assistance. Court papers indicate that no criminal charges were filed. Wilmot Lewis, 85, filed a lawsuit in 2007, alleging wrongful death.
Sources familiar with the negotiations stated that the two sides reached a settlement agreement, in which a judge in Cumberland County Superior Court approved a settlement that would pay Wilmot Lewis $536,837. Legal sources stated that since Marston cannot afford to pay the half million dollar judgment, her insurance carrier will be sued. GEICO, the insurance company, disputes the claim that it was insuring Marston when the crash happened. Wilmot's lawyers stated that if Wilmot Lewis fails to recover the money from GEICO, they will seek payment from Farm Family Casualty Insurance Co., which was Ethel Lewis's insurer at the time she died.
