Medical Technology Rights
Carlsbad, CA: (May-07-08) Alphatec Holdings, Inc., a medical technology company that deals with the design, development, manufacturing and marketing of products for the surgical treatment of spine disorders, has been locked in a legal battle with DePuy Spine, Inc. and Biedermann Motech GmbH, a company that holds the license to pedicle screw technology. The dispute centered on pedicle screw technology licensing, and company officials on both sides recently announced that the parties had reached a settlement and release agreement, resolving the issues.
Under the terms of the deal, Alphatec has obtained a license to intellectual property rights contained in US Patent Number 5,207,678, which is owned by Biedermann and licensed to DePuy. The settlement dismisses all litigation in the matter, and grants Alphatec the right to continue to manufacture, market and sell its Zodiac and Solanas products. Additionally, the settlement agreement also includes a one-time payment of $11 million and an ongoing royalty payable upon future net sales of licensed products. [CNN MONEY: ALPHATEC HOLDINGS, INC.
