Boy Swallows Toys

Shasta County, CA: (May-14-08) The family of 4-year-old William Finley brought personal injury claims against Rose Art Industries, a NJ manufacturer of the controversial "Magnetix" toy, after he suffered serious injuries to his intestines, having ingested one of the magnets from the toy. Hospital records show that Finley began vomiting on Aug. 2, 2005. When it didn't stop after three days, he was taken by ambulance to the hospital, where doctors were unable to diagnose his ailment. Later it was diagnosed that the large intestine had been punctured by a pair of button magnets stuck together within the pelvis. The magnets were part of the toy, Magnetix, which is a modern-day tinker-toy set that attaches parts by magnets embedded in the ends of various-size plastic sections. Following similar complaints, the company has announced two recalls of the toy, and it has been redesigned.

As part of a settlement reached in the case, the agreement calls for incremental payouts of more than $1 million to William, his parents and their attorney. Following the incident, William, now 7, must remain on a special diet for the rest of his life and will endure persistent constipation, diarrhea and severe abdominal pain.
