Stamford, CT: (May-16-08) The state brought a lawsuit against Montville Commons, the developers and construction companies associated with a Montville shopping center, and Home Depot, a tenant and another owner of the center's land, alleging that an unauthorized dam was built on the site that failed to contain rainwater. The state report said that the dam caused homes to be evacuated, and resulted in other storm water management issues from the eastern Connecticut site in 2005.
As part of a settlement reached in the case, Montville Commons, and Home Depot agreed to pay the state $750,000 to resolve allegations. Under the terms of the deal, officials said that the state Department of Environmental Protection will use $200,000 of the settlement to fund a study of the health and environmental effects of recycled tire crumbs used in artificial athletic turfs and for landscaping purposes. The study will prove to be beneficial, as certain studies have shown that rubber crumbs release potentially dangerous compounds when heated and contain heavy metals that can leach into groundwater.
