$54 Million Settlement Approved in Fly Ash Class Action
This is a settlement for the Environment Law lawsuit.
A subsidiary of Constellation Energy Group involved in a class action lawsuit over toxic fly ash contamination in Arundel County, Maryland, will pay more than $54 million to settle the suit. The settlement was approved by a judge in Baltimore on December 30.
The suit alleged that the fly ash contained arsenic, lead and mercury which seeped into the groundwater through the porous floors of the coal quarries.
According to the terms of the agreement, Constellation will connect 84 households, which had previously relied on private wells, to public water over the course of the next 2 years. The company will also pay for their water bills for 10 years or until they move out, whichever comes first. Additionally, Constellation will establish a $9.5 million trust fund for those residents and $500,000 into a separate fund for a second class of plaintiffs, people who lived near the dump sites but who did not use well water.
