Further Settlements Reached in Kitec Lawsuit
This is a settlement for the Consumer and Financial Fraud lawsuit.
Deals with 6 builders and 2 plumbers were reached this week in the defective plumbing lawsuit filed against Kitec plumbing fixtures. The monies will be added to the existing settlement fund.
The suit alleged that Kitec fixtures corrode from a process known as dezincifiation - where water removes zinc from the brass fittings, turning into a silt that ends up blocking the pipes and causing floods and water line ruptures.
IPEX, the maker of Kitec fixtures, agreed to pay $90 million, but the proposed deal is being appealed by Sharp Plumbing. The settlements reached on Wednesday, September 09, 2009 include:
DR Horton: $1,309,900 for about 368 houses
H&H Homes: $126,000 for 35 houses
Classic Plumbing: $5,245,000 for 2,688 homes constructed by 7 builders
KB Homes (second settlement): $5,747,796 for 2,383 houses
Desert Wind Homes: $194,400
Lakewood Plumbing contributed $108,000 to Desert Wind Homes for a combined total of $302,400.
Pulte and PNII: $3,437,500 for 550 houses
Wexford Homes: $625,000 for 72 houses
A court date of September 30 has been set for remaining defendants in the lawsuit.
