The case hinged on which of 2 brothers was driving at the time the SUV rolled over. Thomas Smolinski, 24 at the time of the accident, alleged that his brother Matthew had been driving. The accident caused Thomas to sustain paralyzing injuries.
The settlement monies, awarded to Thomas Smolinski, will be paid by Ford Motor Credit Co, the vehicle's lessor.
