Family Awarded $6.7M in Wrongful Death Suit
This is a settlement for the Wrongful Death lawsuit.
The family of a 26-year old man who was fatally injured by toxic chemical waste while at work, has been awarded $6.7 million in a wrongful death suit.
Francisco Moreno Garcia was a pipe insulator working onsite at a grain processing plant in Decatur. The plant was owned by Archer Daniels Midland Corp. While at the job site Garcia was elevated and harnessed on a 15-foot high scissor lift situated near a recompression evaporator, which contained hot liquid waste. One of the evaporator outlets malfunctioned and shot a stream of hot steam and liquid directly at Garcia. He couldn't disengage from his harness and remained in the direct path of the scalding spray. He sustained chemical burns to more than 90 percent of his body. He died the next day.
Garcia, had emigrated from Mexico at age 18. He left behind his parents, brother and sister to whom he sent money every year.
