$8 Million Settlement Awarded for Construction Site Death and Injuries
This is a settlement for the Wrongful Death lawsuit.
Montvale, NJ: A lawsuit stemming from the death of a 21-year old while working for the family business on a construction site, and injuries to his co-workers, has been resolved with the award of an $8 million settlement.
The young man was performing site clearance work for the family owned landscaping business, which had been subcontracted to clear a site further to the expansion of a parking lot. However, power to the site had not been shut off, and during the course of clearing the site a co-worker was electrocuted, and sustained permanent injuries which prevent him from further physically rigorous work. The young man went to the aid of his co-worker and was himself electrocuted. Both his parents, who were on site at the time, watched their son die. The father was also electrocuted, sustaining injuries to his shoulder.
The lawsuit alleged that the utility company was negligent and was also a proximate cause of the accident and resulting damages, and the project owner had the primary responsibility to notify the utility in advance of work being done on the site.
