Worker Awarded $2.4 Million in Worplace Accident Lawsuit
This is a settlement for the Personal Injury lawsuit.
Wilkes-Barre, PA: HVAC technician Robert Smith was recently awarded a $2.4 million in settlement of a lawsuit he brought against the owners of a warehouse he was working in when he injured himself.
Mr. Smith fell into the gap between a prefabricated set of stairs and a doorway in a Wilkes-Barre warehouse falling 3.5 feet through a 12-inch gap.
The principal owner of the warehouse, Michael Corgan of Corgan Realty and the lease-holder, Corgan Contracting were the defendants in the suit. Corgan claimed that the placement of the stairs was made by Corgan Contracting, of which he was not an employee, and Corgan Realty was not liable as an out-of-possession landlord. Corgan Contracting settled before trial for $800,000.
The jury found Corgan Realty 48 percent, Corgan Contracting 48 percent and Smith 4 percent negligent, so the verdict was thus reduced to $1,995,200, including the settlement.
