Farmers Win Against Bayer Crop Sciences, Jury Awards $48M Settlement
This is a settlement for the Negligence lawsuit.
Dewitt, AR: A group of 12 Lonoke County farmers were awarded compensatory and punitive damages to the tune of $48 million by a jury in their lawsuit against Bayer Crop Sciences.
The suit alleged that Bayer had been negligent in its release of unapproved genetically modified rice in to the commercial rice crop in 2006. Small amounts of the Liberty Link rice were detected in shipments to the European Union, which has a zero tolerance policy to genetically modified foods. Consequently, the EU effectively shut down their market, which caused harm to the farmers.
The jury found that Bayer Crop Sciences, Bayer AG (the parent company) and its various entities were negligent and had acted with "reckless disregard," in their handling of the LL 601 and LL604.
This is reportedly the fourth such case against Bayer that has gone to trial. In all cases the juries have found against Bayer. A class action lawsuit brought by Arkansas County farmers against Bayer is pending.
