Nursing Facility Settles Suffocation Lawsuit for $190K
This is a settlement for the Nursing Homes lawsuit.
Clinton County, NY: The family of a patient who suffocated in her bed in an upstate medical center will receive $190,000 in a last minute settlement. The lawsuit was filed by the family of Lottie D'Aust, who died after becoming trapped between a bed rail and a mattress in the skilled nursing facility of Champlain Valley Physicians Hospital Medical Center, in Plattsburgh.
The suit claimed there was no need for railings on Lottie's bed, and that the nursing home was negligent because it failed to install an alarm at Lottie's bed that would have enabled her to summon help.
The defense contended that the bed met FDA guidelines and that monitors often cause more problems than they solve. While the jury was deliberating, the sides struck a settlement.
