Severe Workplace Accident Results in $7 Million Settlement
This is a settlement for the Negligence lawsuit.
Corpus Christie, TX: A $7 million settlement has been reached in a personal injury case involving a man who suffered severe burns to his face, neck and arms while working at the Crude and Vacuum unit of Citgo' East Plant.
The case, Jose Herrera II v. Refined Technologies Incorporated, claimed that on February 22, 2008, Herrera was connecting an injection cleaning apparatus into the Crude and Vacuum Unit, located between Nueces Bay and Buddy Lawrence Drive, when the connection point broke and hot oil started spewing out. Herrera' face, neck and arms were severely burned. The now 50-year old man had to undergo a year of painful skin grafts and debridement treatments for his injuries along with other medical procedures.
An investigation into the incident found the cause was equipment failure due to the alleged negligence of the defendant Refined Technologies Incorporated, the company charged with designing the injection cleaning apparatus, overseeing its installation and safety for the job being performed at the time of the accident.
"It' been three very long and painful years for Jose and his family. He' had to undergo excruciating medical treatments for his injuries,"said the Herrera family attorney. "It' imperative that companies follow strict procedures and be diligent in making sure that equipment is safe and in good working order to protect workers."
Two other workers were also injured in the incident. Both men received a small portion of the settlement.
