Nitro Residents Win Against Monsanto in Environmental Class Action
This is a settlement for the Environment Law lawsuit.
Winfield, WV: A proposed settlement has been reached in an environmental class-action lawsuit against the chemical manufacturer Monsanto. The lawsuit, brought by residents of Nitro, claims that Monsanto unsafely burned dioxin wastes which resulted in the spread of contaminated soot and dust across Nitro, polluting homes and making them and the surrounding environment toxic.
The former Monsanto plant produced herbicides, rubber products and other chemicals for more than 50 years. The most notorious chemical it produced was Agent Orange, which created dioxin as a toxic chemical byproduct.
The residents of Nitro filed their lawsuit in 2004, seeking medical monitoring for between 5,000 and 80,000 current and former Nitro residents.
The proposed settlement must be approved in court before it can proceed. Details of the settlement are not currently available.
