Skechers Settlement
Louisville, KY: A federal judge tentatively approved a $40 million settlement in the class action lawsuit Grabowski v. Skechers U.S.A., Inc., No. 3:12-cv-00204 (W.D. Ky.) on August 13, 2012. The lawsuit claimed that Skechers violated certain state laws and consumer protection statutes in connection with the marketing and sale of their toning shoes. Skechers allegedly misled consumers in its advertisements by claiming that its footwear would help people lose weight and strengthen muscles.
Consumers will be able to get reimbursed for their Skechers toning shoes since August 1, 2008 with limited exclusions: up to $80 per pair of Shape-Ups; $84 per pair of Resistance Runner shoes; up to $54 per pair of Podded Sole Shoes; and $40 per pair for Tone-Ups.
If Preliminary Approval of the Proposed Settlement is granted by the Court, consumers will have the right to opt-out of the settlement or object.
