Aurora Organic Dairy Settles Consumer Fraud Class Action for $7.5M
Boulder, CO: Aurora Organic Dairy, based in Boulder, has agreed a $7.5 million settlement potentially ending a five-year-old consumer fraud class-action lawsuit against the company.
The lawsuit was filed against the dairy, which supplies many U.S. grocery chains, on behalf of two St. Louis-area mothers in 2007. They alleged the dairy employed unfair and deceptive practices to sell non-organic milk at organic prices. The lawsuit also alleged the company's milk didn't live up to USDA organic standards.
In 2009, a federal judge in St. Louis dismissed the suit, saying Aurora's products had been deemed organic by a USDA-accredited certifying agent. However, a company spokesperson said that the dairy chose to settle the litigation despite having done nothing wrong, because it was tired of the litigation.
