$1.8M Settlement Reached in Neutrogena Naturals Class Action Lawsuit
New York, NY: A $1.8 million settlement has been agreed in the consumer fraud class action facing Neutrogena Corp. If approved, consumers who purchased Neutrogena Naturals products may be eligible for a refund up to $10 per person.
The lawsuit, entitled Stephenson v. Neutrogena Corp, Case No. 12-cv-00426, in the U.S. District Court for the Northern District of California, alleges the Neutrogena Naturals products were deceptively advertised. Specifically, the lawsuit claims that six of Neutrogena' "natural"cleansers and moisturizers contain synthetic ingredients like petrochemicals, sodium benzoate, propylene glycol, glycerine and other unnatural components, in contradiction of marketing claims that the products are "natural".
The lawsuit states that marketing claims concerning Neutrogena Naturals specify the products contain "no harsh chemical sulfates, parabens, petrochemicals, dyes [or] phthalates." According to the lawsuit, Neutrogena' website also contains similar claims, describing the products as "pure, natural skin care"that promise "real results."
As part of the settlement terms, Neutrogena must pay $1.8 million in class compensation and attorneys' fees, and change the labeling and packaging of its products.
Consumers who purchased Neutrogena Naturals Purifying Facial Cleanser, Purifying Pore Scrub, Face & Body Bar, and Fresh Cleansing + Makeup Remover since January 2011 will be eligible for $1 per purchase. Consumers who purchased the company's Multi-Vitamin Nourishing Moisturizer or Multi-Vitamin Nourishing Night Cream during the same time frame can recover $2 each. Compensation is capped at $10 per customer.
