West Publishing and Kaplan Reach Proposed Antitrust Class Action Settlement
This is a settlement for the Antitrust lawsuit.
Los Angeles, CA: A proposed $9.5 million settlement has been reached in the antitrust class action lawsuit pending against West Publishing Corporation and Kaplan, Inc. (Stetson, et al. v. West Publishing Corporation, et al., Central District of California Case No. CV-08-00810 R).
If you paid for a BAR/BRI full-service bar review course from August 1, 2006, through and including March 21, 2011, you may be eligible to receive a cash payment from this class action settlement, which supersedes the prior proposed settlement for which you may have received a notice in April 2011.
The lawsuit alleges that BAR/BRI violated federal antitrust laws by agreeing with Kaplan to limit competition in the market for full-service bar review courses. West was the owner of BAR/BRI during the relevant period.
Defendants have agreed to pay the total sum of $9,500,000 (the "Settlement Fund"). After deductions for Class Counsel's attorney's fees and costs and other amounts associated with the settlement as approved by the Court, the remainder of the Settlement Fund will be distributed to Class Members who submit timely claims in proportion to the amount that they paid for relevant BAR/BRI courses.
To receive a portion of the Settlement Fund, you must submit a Claim Form, postmarked or submitted online by July 8, 2013. Alternatively, you may submit a request to exclude yourself from the Class by the same deadline, in which case you will not receive any portion of the Settlement Fund, but you will preserve your right to bring your own suit for the conduct alleged in the lawsuit. If you do nothing, you will remain in the Class but will not receive any money. If you do not exclude yourself from the Class, you may also object to the settlement and/or Class Counsel's request for fees and expenses and other proposed deductions from the Settlement Fund. To do so, you must mail a written objection to the Claims Administrator postmarked by July 8, 2013.
