$8M Settlement Awarded in Mattress Pad Suffocation Lawsuit
Santa Clara, CA: An $8 million verdict has been awarded to the family of a 7-month-old girl who died in 2010 as a result of suffocating during a nap in an Evenflo Baby Go Madison play yard. The defective products lawsuit was brought by Tiffany and Dave Karow, of San Carlos, who alleged their daughter suffocated to death on a mattress pad manufactured by the company because she couldn't breathe through the material.
Abigail Karow was found face down and unresponsive in an Evenflo Baby Go Madison play yard on April 21, 2010. She was pronounced dead after 36 hours on a respirator.
Originally, physicians attributed Abigail' death to sudden infant death syndrome, or SIDS. Howver, Abigail didn't demonstrate any SIDs symptoms.
According to the attorney representing the parents, results from laboratory tests ordered by the plaintiffs to determine the permeability of more than 30 mattress pads, showed the Evenflo product was on par with a plastic bag.
The Karows hope the verdict leads to mattress pad regulations.
