$1.5M Settlement Awarded in Professional Misconduct Lawsuit
Santa Clara, CA: A professional misconduct suit alleging sexual harassment
has reached a $1,568,750 million settlement. The lawsuit was brought against White Memorial Medical Center in Los Angeles, CA, by Margarita De La Rosa, who alleged she was sexually assaulted by a male physical therapy assistant (PTA) during a physical therapy session at the center.
The specific allegations made by the plaintiff were that the PTA took her to a private room and during the course of doing soft tissue mobilization on her back and legs, he intentionally touched her genitals. The male PTA had a prior complaint about touching another female patient improperly over the clothes several months earlier at the same location.
That defendant hospital was found 65 percent liable for the conduct of the physical therapy assistant, while the individual perpetrator was seen to be 35 percent at fault.
