Plaintiff's Complaint:
Defendant developer removed vegetative cover from 80 acres and moved dirt with no erosion control. 1000 truckloads of mud went into 5 acre lake. Court order after Court order on injunctive relief led to had the damages being punitive damages. Judgment was appealed and upheld; Illinois supreme court declined to overturn punitives on 9-30-15.
Injury, Damage, or Loss:
Lake was destroyed from erosion of soil into lake in an on-going nuisance case from 2011 to 2012; trial was sept 2013 but verdict was just confirmed and this has not been reported before now by anyone!
Defendant's Wrongdoing:
Defendant developed land in a manner that created a nuisance from soil erosion destroying a 5 acre lake with sediment that choked off the lake
