Jefferson County, TX: A lawsuit naming 22 companies as defendants in the death of the late William Earl Davis was recently filed. The suit claims the defendants were negligent in exposing Davis to asbestos-containing products, which subsequently led to his asbestos-related death.
Court records show that Davis worked as a pipefitter and the suit alleges that it was through this work that he was fatally exposed to asbestos. “Defendants negligently permitted asbestos products to be uses on their premises despite the fact defendants knew … asbestos products … were extremely dangerous to human health,” the suit states, adding that the defendants also negligently manufactured, sold and used asbestos products without warning workers of the dangers.
The defendants named in the suit include: A.W. Chesterton, Bechtel Corp., Chevron USA, Crane Co., E.I. DuPont, ExxonMobil, Fluor Enterprises, Fluor Maintenance, Foster Wheeler Constructors, Foster Wheeler Corp., Foster Wheeler Energy, Goodrich, Goodyear, Goulds Pumps, Ingersoll Rand, Longhorn Gasket & Supply, Metropolitan Life Insurance, Mobil Chemical, Mobil Oil Refining, Owens-Illinois, Texaco and Total Petrochemical.

Jefferson County, TX: American Optical is one of 15 named defendants in an asbestos lawsuit filed by the wife of the late Milton Deculus. The suit alleges that the defendants exposed Mr. Deculus to asbestos and caused his death.
The other defendants named in the suit include Chevron USA, Dana Companies, ExxonMobil, Guard-Line, Honeywell International, Huntsman Petrochemical, Ingersoll Rand, Metropolitan Life Insurance, Minnesota Mining & Manufacturing, Mobil Oil Refining, Owens-Illinois, Oxy USA, Pneumo Abex and Texaco.
Deculus lived in Texas throughout his career as a laborer, welder and truck driver, the suit states. And, it was during his employment that he was exposed to asbestos-containing products which led to his developing asbestos-related disease. The suit does not state when or how Mr. Deculus died.

New Orleans, LA: The first week of deliberations in a two-and-a-half week asbestos trial wrapped up this week, in Orleans Parish Civil District Court.
The suit was filed by a former Avondale shipyard employee, Ferdinand Truxillo, who alleges that 28 companies, including General Electric, CBS Corp. and Northrup Grumman, exposed him to asbestos during the course of his work at Avondale from 1967-1969 and from 1970 to the present. Truxillo filed the suit in October 2010. Shortly thereafter, 16 of the original 28 defendants, including CBS, where dismissed before trial.
The suit alleges while Truxillo worked at Avondale, “dangerously high levels of asbestos fibers escaped into the ambient air of the work place, resulting in petitioner breathing those fibers.”
“Defendants knew or should have known through industry and federal studies … the existence of which were unknown to petitioner, of the health hazards inherent in the asbestos-containing products,” around Truxillo. And, that the defendants were “manufacturers/equipment/sellers/suppliers/distributers/contractors” that worked with asbestos.
The lawsuit claims the defendants are guilty of strict liability, negligence, intentional tort and fraudulent misrepresentation, among other charges.(Louisianarecord.com)
Elyria, OH: The Ohio state attorney general is suing a Lakewood property owner over illegal asbestos removal. The property owner allegedly hired a contractor who did not follow asbestos removal protocol when demolishing buildings in Elyria.
According to Ohio law, a thorough remediation plan must be filed through the Ohio EPA any time asbestos is removed from a building. This plan must be followed precisely to ensure the carcinogenic asbestos particles do not become airborne in the community.
The two properties concerned are at 518 and 522 Middle Avenue, and were demolished in May 2007. At that time, Donald Mountain, of Lakewood, was the listed owner of the two properties, and he hired Cleveland-based Richard’s Your Outdoor Connection Inc., to destroy the buildings.
According to a lawsuit, neither the owner nor the contractor notified the Ohio EPA regarding the planned demolition of the properties. Consequently, a thorough asbestos inspection of the properties was not done prior to the buildings being torn down and the site being cleared.
The lawsuit alleges that the property owner “increased risk to the public health and environment, and illegally thwarted the ability of the Ohio EPA to ensure that the quality of air in Lorain County is protected from the emission of airborne asbestos.”
The contractor, Richard Whitt, did secure two demolition permits from the Elyria Building Department, but failed to follow up with the Ohio EPA for the proper prior inspection and notification. The suit is seeking a civil penalty award of $25,000. (chroniclleonline.com)
how can i be tested for meso. have been dianosed twice already for asbestosos related lung problems.which results came back positive i had two independent tests two week apart cant seem to get a straight answer from doctors they give me the impression they dont want to get involed with pending litigation
I just lost my Dad to meso, August 15, 2011, he wasn't diagnosed until they operated and the meso was spread everywhere, he actually died from the surgery which was on the 12th. I pray for you because he had surgery for a "lung infection" 6 months before. The last 6 months of my Dad's life were in debilitating pain. His hard work and 30 years of dedication killed him. I will get justice for my father. I miss you Daddy
