You’d think Avon would have enough on its vanity right now with those alleged Avon bribery charges in overseas markets and that CEO search they’ve got going on. But, in true hit-’em-when-they’re-down fashion, Avon—along with Mary Kay and Estee Lauder—has just been hit with class action charges—for deceptive and misleading conduct in “marketing, selling, promoting and distributing cosmetic products in the United States”.
More specifically, the newly filed class action is going after the makeup companies’ ‘no animal testing’ claims. (Before we go on, please note, no animals were harmed in the photoshopping of the above image.)
The false advertising class action lawsuit was filed by lead plaintiff Marina Beltran (Beltran et al. v. Estee Lauder, et al., United States District Court – Central District of California, Case No. SA12-CV312 CJC (ANX)) on February 28, 2012. Beltran and her co-lead plaintiffs claim Avon, Estee Lauder and Mary Kay engaged in animal testing on their products even though they advertised that they were “cruelty-free”. The court documents also state that the beauty companies conducted animal testing in order “sell products in China and other foreign countries, thereby reaping hundreds of millions of dollars in sales.” (Wait a minute—China? Wasn’t China the major focus of that Avon bribery investigation?)
The filed court documents state that the “Defendants later purported to disclose, at least on their websites, that they in fact were animal testing, but the disclosures were wholly inadequate and deceptive.”
Not one to sit on the sidelines where animal cruelty is concerned, PETA (People for the Ethical Treatment of Animals) has kicked the companies off its “cruelty free” list, though I imagine that for Avon, that downgrade hasn’t had quite the same sting as the downgrades given to AVP stock by some analysts recently. When it rains, it pours.
Actually, the PETA downgrade is key to the animal testing class action—the court documents state that because Avon, Estee Lauder and Mary Kay had been granted a cherished spot on PETA’s “cruelty free” list, the companies benefited financially—i.e., customers who proactively sought out cosmetic products that were not tested on animals would refer to PETA’s list and patronize those companies on the list.
It’s estimated that the class size for this one is in excess of 1,000,000 members—and the makeup company animal testing class action lawsuit is seeking compensatory damages of $100M.
YES! It is about the time that they get stopped. They should produce certified organic cosmetic like ONEgroup that has Miessence products. They never test on animals and their production is environmentally friendly. There are different methods for testing products, after all we live in technology age.
Being Vegan,I decided to begin selling 'Avon' for a short time,because it was 'cruelty free'.I rarely find any products that I can use.Then I couldn't find any real information on them.
The products were so full of chemicals and perfume that I ended up throwing them away,and lost my money.They also insisted that I buy $20.00 worth of books every week also,which no one wanted and went in the trash.What a joke,what a lie,what a waste.
Hi Joyce–Don't worry, with reportedly over 100% Avon lady turnover, you're clearly not alone in ditching that gig. It'll be interesting to watch the fallout of all this, given that the "cruelty free" label was something Avon apparently took pride in. Guess the message–for those wanting cosmetics or any other product that hasn't been tested on animals–buyer beware.

I guess even Reese Witherspoon can't help Avon with that.

This is news to me and I had just been asked to return when there were management changes. I had no idea they tested on animals and my reputation is worth more to me than a few dollars from Avon – I also agree with Joyce that the book prices are absurd (and so is the return policy on the dime of each rep despite the fact that they have no control over the product. I am soooo out of there now….thanks for posting this.
Wow….such great information. I work with Rodan + Fields and we do not animal test..Am proud to be with a company that is truthful about ingredients and results.

Avon has proven that it's more interested in profits than in people. My building is posted "no trespassing / no soliciting", but they still manage to get in and dump their advertising trash on every door in the place. When I complained to Avon because I fell and was injured while trying to pick up their garbage (I'm handicapped), they told me that Avon representatives don't actually represent Avon! Pretty good how they can twist words around in order to protect themselves!

Why thank you so much for your passionate comments regarding Avon Products! You just might be in the running for honorary Avon Lady of the year. Oh wait, will the company survive another year? Hmm, those 1Q results (AVP at $13! OUCH!!) and that little hiccup of the $132M tab to settle those bribery charges…well, what can we say? Of course that doesn't even begin to take into account the $$$$ that the company has spent defending itself. Oh, and let's not forget the serial layoffs the company's been doing–"restructuring"–nice that the workers and shareholders are left holding the bag after the misdeeds of those at the top. Gee, animal testing sort of seems tame (excuse the pun) compared to allegations of illegal business tactics of such a scale, no? As to your own allegations re our sexual proclivities and/or needs, thanks for looking out for us! But, my sense is that you're a bit overly focused on our sexual well-being–maybe worth looking into?
