Know what gets a lot of traffic at LawyersAndSettlements.com? Anything CertainTeed. CertainTeed lawsuits. CertainTeed settlements. CertainTeed-related comments about the weather. You name it, folks love clicking a CertainTeed link. So, in honor of all of you who’ve clicked away, here’s a CertainTeed story that might pay off for you: the CertainTeed Organic Shingle Settlement was approved at a court hearing last week.
[Little disclosure: as with the Lawn Mower settlement, LawyersAndSettlements.com has absolutely nothing to do with this—we’re not affiliated or connected in any way to the Settlement, not in bed with the law firms involved, not getting any cut of this…we’re just reporting it…]
So this Settlement is the result of a defective product lawsuit claiming that CertainTeed Organic Shingles that were manufactured between July 1, 1987 and December 31, 2005 were defective and failed to perform as promised when installed on homes and/or buildings in the US and Canada.
Now, don’t get all giddy too quickly. I’m telling you upfront, this Settlement—if you’re a part of it—will require a bit of homework on your part. So here we go…
The settlement applies to these folks only (aka, the “Class Members” —and yes, you need to be a member of this little club to receive any settlement monies) AND you also need to meet certain eligibility requirements once you pass the “test” to be considered a Class Member. So first, let’s look at who qualifies as a Class Member…
You are a CLASS MEMBER of the CertainTeed Organic Shingle Class Action Settlement if you:
1. Owned a home or other building in the US or Canada as of December 15, 2009 on which CertainTeed Organic Shingles were or had been installed;
OR
2. Owned such a home or building prior to December 15, 2009 but sold or transferred it—and at the time of the sale or transfer, you retained the right to make a claim for the shingles pursuant to a valid documented assignment;
OR
3. Have settled a warranty claim with CertainTeed regarding Organic Shingles between August 1, 2006 and the effective date of the settlement agreement. (The “effective date” is 30 days from when the Court gave its final approval to the Settlement if there are no appeals.)
Now, if you meet one of the above, here’s the next hurdle you have to clear: Eligibility.
To be ELIGIBLE to file a claim and receive payment from the CertainTeed Settlement, you have to:
1. Be a Class Member.
2. Ensure that the shingles you’re filing a claim for meet the definition of “Damage” according to the Settlement agreement; (This is key, and I urge you to visit the CertainTeed Organic Shingle Settlement Claims Administrator’s website for specific details—the website address and toll-free number are at the end of this post.)
3. Ensure the damage occurred before the end of the shingles’ warranty period.
4. Ensure the damage was caused by a product defect—not by circumstances beyond the control of CertainTeed—such as improper installation or maintenance.
5. (and this one should be a no-brainer, however, not so…) Submit a Claim Form on a timely basis! Seasoned claim form submitter that you are, you’re probably thinking there is just one date for everyone to postmark there claim form. No. The exact wording from the Claims Administrator on this is:
The deadline for filing a claim form varies depending on your particular circumstances. To determine the deadline for your Claim Form, check below to see if the warranty for your CertainTeed Organic Shingles covers you. If so, you can submit your claim any time allowed under the warranty…. If you are not covered by the warranty or if you settled your warranty claim since August 1, 2006, your claim form must be postmarked or otherwise received by CertainTeed within 12 months after the Settlement Effective Date.
Little reminder: that Settlement Effective Date is 30 days from when the Court gave final approval of the settlement if there are no appeals.
The Claims Administrator’s website (see information below) does a good job of trying to sort out when your claim form is due, based on the year your shingles were manufactured; basically, the limited warranties for each type of CertainTeed Organic Shingle differ by year of manufacture—so there’s a number of variables at play here—but if you’re still under warranty, it looks like you can submit a claim any time during the warranty period; if not, or if you’ve settled your warranty claim since August 1, 2006, then you have until 12 months after the Settlement Effective Date to postmark your claim.

Hi Dave, Here's the status of the Certainteed Organic Shingle settlement–so things won't really get rolling in terms of any dispersements until at least Oct 2nd…
On September 1, 2010, the District Court entered an Order for Final Certification of the Class, Approval of Class Action Settlement, and Entry of Final Judgment. As explained in an accompanying opinion, the Court granted final class certification and approved the Settlement Agreement as fair, reasonable, and adequate. Unless an appeal is filed from the Court’s Order by October 1, 2010, the Settlement Agreement will become effective on October 2, 2010, and CertainTeed will begin processing and paying claims shortly thereafter.
this sure has been a long process with all the paper work and forms to fill out, let alone all the expense for replacing a roof, in the amount of 7000.00 in which we are not even getting a small portion refunded. we have been told we will be lucky to get 350.00 for all this mess that this company has put upon thousand and i mean thousands of people. as far as im concerned they should be put out of business, or give a complete refund to all. with that said i fell sorry for all of those people who thought they was buying a very reputable product and found out different years later, with the times that this economy is in, i am sure many can not afford this extra expense

OK, last week I finally got the 50.00 they promised for the shingle removal to send it in. Why just the 50.00, when will the actual settlement come?

So best I can say for now is that "they're working on it"…and given how many claimants there may have been in total, and the complexity of this one, it may take some time for the claims to be processed.
After all of the work to send in the claim, we received a letter that our shingles are not organic. I am having difficulty accepting this since all of the many different roofers who have done repairs have said they were organic. Anyone else have this happen? Can we get them tested independantly?? UGHHHHHHH!!! What a scam!!!
I just got a check from Certainteed in the amount of 2,800. No explanation, nada! I was part of this and like all of you I feel we have really been taken. I paid for a roof that I thought would take me all the way to the soldiers and Sailors home but brother was I wrong.
I just received a check for 2300.00 to replace my shingles talk about a lap in the face, that's not going to cover the cost to replace this mess they made with there crap product. I am on a fixed income so looks like thanks to certainteed I'm just going to have a leaky roof. I will advice all my friends NEVER to buy anything from them as they don't honor their product replacement and it's not slander if you know it to be the truth. wonder who is lining their pockets with the money left from this settlement.
I just received a letter dated January 25, 2011 requesting additional information. I find this highly suspect since I fulfilled all requested information in my original claim submission….long ago. My roof shingles were definitely Certainteed shingles as indicated by the original roofer's invoice which I paid long ago. My roof was in such bad condition that I could not trust it for the winter and so I had to have it replaced. Now Certainteed wants a full shingle and photos of the roof. This entire matter is evolving into a legal scam and I note that recently even checks bounced. This entire process along with Certainteed's warranty are unbusinesslike.
I purchase a house 2 years ago and found out that it has the defective organic shingles. I cannot find the prior owners warranty. Am I still able to file a claim and be part of the suit?
How can they get away with paying for the shingles only? What judge ruled on this and what was he smoking…Now we will end up paying for the installation…what a bunch of #$@%.
I sure missed out on this one. I am a professional roofer (retired) who just inspected a roof with the sealdon 25 shingles that are disintegrating after 11 years. I wonder if the company will make good on the warranty after the class action lawsuit. Any ideas on this?

Whata crock of sh** I got 430.00 check for 30 Sq of shingles.They have not heard the end from me.There will be billboard explaing how the f***ed me.
We just received the form that we are eligible to submit the Abbreviated Claim form and we already submitted a warranty claim to Certain Teed. It is asking for my Certain Teed Warranty Claim Number. Is this the same as the reference file number on top of the letter we received?
