      Hi Shirley, Latest I know of is that claims are being reviewed/processed….it does take time given the amount of claimants, so it may be a while before you receive anything back

      Hi Chris, Chances are, it's still on its way. It takes a fair amount of time for the claims administrator to review and process all the claims that come in for a major class action, so it may be a bit of time before your check arrives.

    Horsepower misrepresentation is NOTHING compared to audio amplifier wattage misrepresentation. There are NO standards whatsover such as Peak to Peak, Peak, Average, RMS (root mean square), Continuous power, etc. In the 70s, audio amps were rated in RMS power. Kids today think they are buying a 1000 watt amp for their car for $150 when a real quality amp (CROWN) rated at 1000 RMS watts costs many times more and would set their car speakers on fire in less than a second!

    You can go on and on with these kinds of lawsuits.

      Hi Henry, The website for the lawn mower class action settlement is the best place to find updates on the status of things; if you go there, under where it says "about this settlement", on the right side you see an update that was dated Oct. 25th; in there it says, "On August 16, 2010, Judge Adelman granted Plaintiffs’ motion for final approval of the settlements with all defendants. Please keep in mind that appeals may be filed and no distributions (cash payments or warranty certificates) can be made until any and all appeals are resolved. Please check back on December 31, 2010 for additional updates as to any appeals or the date of cash and warranty distributions (if no appeals are filed)."
      Large class actions such as this can take some time–so it's best to bookmark the site and check back on Dec. 31st, as they indicate, for any updates on the appeals process or distributions, assuming no appeals.

    I am inquiring about the claim that I submitted on May 20, 2010 for this lawnmower lawsuit. The confirmation # is T2B7BAA7BO and I am inquiring about this for my father because he does not have a computer.     It seems like waiting for so long should be understandable, after all we are dealing with a large amount of claimants and just a handful of people to handle the refunds. Perhaps the companies should hire a lot more temporary people to take care of this,as they don't waste any time taking their profits from sells or collecting debts owed to them.

    Seems I have a dilemma with this that I can’t get resolved on the lawnmowerclass.com. I filed online earlier this year but never received thing one from anyone. Just today I remembered this and searched to find the cut off for the refund was August 2010. There’s no number listed to reach an actual person either on the notice card OR the website and the 877 number is just recorded options with nothing to reach a person. So, I followed the instructions and filed waaaaaay before the deadline but somehow I’ve been passed over. What can I do or who do I contact? Typically I wouldn’t care so much about the money exampled by issues with my Kohler twin 25hp motor
    (@ 154 hours two lifters kept losing their prime) which I repaired it myself, out of pocket. It wasn’t long when the new lifters started doing the same thing and I DO keep my blades sharpened AND the oil/filters changed using quality name brand parts. When I called Kohler’s customer service about this their Tech finally admitted it’s a design flaw and after some prodding sent a retro kit to stop this. Again, installed by me so yeah I feel $35 is the least Kohler can do towards my time/gas/labor which is not even half of a shop rate not to mention out of pocket for the new lifters/gaskets. I’m not out to milk anyone but DO expect the quality I paid for but didn’t get when I bought the mower new so I DO want what I filed for. I have what I think is the claim number given when I filed but on the site there’s no place to enter it. What can I do???

      Hi Mike, If you did indeed submit a claim for the lawnmower class action, and you haven't heard anything yet–it may well all be alright. The next update for settlement is I believe on December 31st–that's the date by which any appeals to the proposed settlement would have been submitted and resolved. Cash settlements cannot be paid out until all appeals have been resolved. You can find updates on the status of this at lawnmowerclass.com. Hope this helps!

    One thing I've learned from my 23 years as a Cop is the Legal System has 3 speeds: Slow, Dead Slow and Stop. Personally I'm FPO'd about this. This ENTIRE lawsuit is about CONSUMER FRAUD, nothing else! If you bought 20 gallons of gas every week and found that you only got 17 gallons would you be pissed? It's the SAME thing folks. We paid for something we DID NOT get.

    Have things changed as result of this lawsuit? Check out Sears, Toro and MTD's websites. Do they boast HP anymore? NO!

    I sent in the forms you requested. I purchased two John Deere riding lawn mowers #LA135 — one from Samuelson Equipment in Hastings, NE and one from Plains Power & equipment in York, NE.

    I have never received the status of those requests. There is NOTHING about this process that is "user or customer friendly"!!

    You have NOT made this process simple nor understandable — guess that's what happens when you get lawyers involved.

    If I do not hear back from a real person within a suitable time, I will turn this matter over to my personal attorney. If I do not get fair treatment as per this legal settlement, I promise you there will never be another John Deere in our family — mine or our 3 adult children!! Toro will become the brand of lawn mowers used by our entire family.

      On August 16, 2010, Judge Adelman granted Plaintiffs’ motion for final approval of the settlements with all defendants. Subsequently, some of the class members who objected to the terms of the settlements filed notices of appeal with the Seventh Circuit Court of Appeals. The Seventh Circuit Court of Appeals recently dismissed the relevant appeals and the settlement proceeds will soon be ready for distribution to class members. The Claims Administrator is currently processing the claims received by class members. Class members who filed a valid claim can expect to receive a cash payment and engine warranty certificate (if applicable) by April, 2011.

    Where in the world are the settlement checks? I feel like I need to hire an attorney to place a claim against the attorneys who handled the settlements? The web site provides very little information and there is never a live person to talk to just some recording that has spewed out the same rhetoric for months. First it said checks would come in March, than April now it says Middle of May. This is ridiculous! The lawyers made millions on this and they can’t cut the checks in a timely manner!

      Hi Disgruntled, While it's aggravating and annoying that it's taken (taking!) a long time for folks to receive their checks from the lawnmower settlement, this is typical of a very large class action lawsuit. I don't know the exact number of claimants, but it's undoubtedly a huge number–and this class action is also complicated by the fact that it's multiple defendants (ie, not just one brand) and also there is a warranty component that has a different filing date–all of which needs to be sifted through, verified etc before payments are sent out. Believe me, I get that in this day & age it would seem that there's some simple computerized scanner that's checking claim forms and spitting out checks–but it doesn't quite work that way–all those claim forms that were hand-written need to be reviewed one by one.. Also, I might mention, since you bring up a common fallacy–ie, that "lawyers made millions"–let's just take a look at that claim.

      See, the class counsel on this lawnmower fraud case–that is, the lawyers who fought the case–began working on it in 2003. That's when they began the investigation after receiving a tip from an industry insider. The lawnmower class action was filed in 2004. Since then, it's worked its way through the courts–and as you can imagine, the defendants weren't about to sit back quietly–which adds to the amount of time it takes and the need for the class counsel to respond to and address the defendants motions. So, let's take a look at the numbers–and I do not have any more info than is publicly available on this –but here goes…

      The lawyers–and there are 2 firms acting as co-lead counsel on this one–stand to make 1/3 of the cash settlement plus interest and also $14 million for the warranty component of the settlement. That's roughly–this is just an estimate as I'm not figuring out the actual interest–$35.5 million total. Now, for argument's sake, let's put the tax rate at 35%, which nets out to $23,075,000 for the lawyers. Now, split that into 2 as there were 2 firms as co-lead counsel and that leaves each with $11,537,500. Wow–sounds like a lot of money, right? Ok, now figure that the lawyers have been working on the case for NINE years. That's roughly–and again, I'm just doing some guesstimate figures here–$1,281,9444 per year per firm. Now, assume all the lawyers'–and it's not just one lawyer involved here–salaries, and their staff salaries (paralagels, junior or associate attorneys, admininistrative staff) and benefits, and all that comes with running a law office…all the overhead etc. Now, add onto that the fact that many lawyers actually have to take out loans to be able to litigate anything as they're working on contingency–meaning that for those nine years, they've fought this case and haven't received a dime for it in the meantime. So they may well owe money (with interest) just to have taken on the case to begin with.

      I'm not saying anyone should shed a tear for the lawyers, but folks need to realize that those big settlement numbers you hear are not some slam dunk for the lawyers involved. Most claimants only found out about this settlement within the last year and a half or so–and yet the case has been going on for 9 years.

      Finally, it's not the lawyers who process the claims that come in for the lawnmower settlement–it's a separate, independent claims administrator (in this case, Rust Consulting).

      Hi Lawyers…, See the response to "Disgruntled". I doubt the lawyers will really see all that much–yes, it'll be more than the $10-$15 that most claimants see, but then again, I imagine the lawyers have shelled out more than the cost of a lawnmower to litigate the case. Before becoming aghast upon hearing the amount set aside for "attorney fees" make sure you completely understand the system, the process and time involved, the players and what the actual numbers mean. I'm not one to jump on the lawyer bandwagon–but I understand the reality of trying to run a business for nine years while you're waiting for payment to come in–the money's got to come from somewhere to pay staff salaries & benefits and keep your doors open–and typically it comes from the attorneys going out on a limb and taking out loans to fight a case–with no guarantee of a win. So as I said to Disgruntled…take the gross proceeds the lawyers stand to make; divide by two for two firms involved; back out taxes; spread it out over nine years; factor in all the staff salaries/benefits, overhead, expenses to litigate, loan & interest repayment, etc…and the lawyers aren't exactly raking it in.

    I just got my $10.19 check today. I'm gonna buy a 6 pack of talls and drink em in front of the Sears I bought my mower at. Since I bought it I said there was NO WAY it had 6.5hp as my Father's old Jacobsen 3.5 hp from the early 70's out preformed the Craftsman 1000%.

    If I buy a gallon of gas I expect 128 oz of gas, not 115 oz , not 99 oz or 86.6 oz. F@#$ You Sears!

          Hi Dick, Re the warranty, my understanding is that the one year warranty certificates are only if your mower's engine had a manufacturer's warranty at time of purchaase. This is the wording from the settlement site: Warranty Benefits: If you are a Class Member and you submit a valid and timely claim, you will receive a one-year extended engine warranty if you own a lawn mower containing an engine manufactured and originally warranted by Briggs & Stratton, Toro, Tecumseh, TecumsehPower, Kawasaki, or Kohler. To qualify, your Briggs & Stratton, Toro, Tecumseh, TecumsehPower, Kawasaki, or Kohler manufactured engine must have had a manufacturer’s warranty at the time of purchase.

          I'm assuming yours probably had the manuf. warranty and you, therefore, should've received the certificate–I did not think they were being mailed separately, but then again, the info I have is basically the same that all claimants have access to. So my suggestion would be to wait a bit longer to see if perhaps the warranty info is actually being sent separately, and then if nothing arrives, your best bet is to try to contact the claims administrator directly.     Wait till you try to use the "Extended Engine Warranty". Both John Deere and Kawasaki said "they are not to blame" and pointed to the other as responsible for fulfilling the warranty. Meanwhile, I'm stuck with a bill for $187.11 for engine repairs. Something really stinks about this. Either honor the warranty or don't issue one. It looks like Kawasaki is trying to get away with something here.

    Well looks like this whole deal is a scam, I took my John Deere to the Dealer and they will not honor the extended warranty sent to me. They said Kawaski would have to do the repairs. I spoke with a Service Manager at a Kawaski dealership and he said John Deere would have to repair it. Nobody is honoring this lawsuit or its warranty. Everybody says somebody else is responsible. It plainly says on the lawsuit site that John Deere Mowers are to be taken to a John Deere Dealer. So far I can't find anyone that has anything to do with this???

    I have a Toro Walk Behind and received the Extended engine warranty which expires in March 2012. 2 weeks ago I had an engine oil leak, took it to an authorized Toro/Tecumseh dealer, presented the copy of my extended warranty, and they found that the engine pan gasket was leaking. They called for authorization and it was denied because the mower is 5 years old irrespective of the extended engine warranty. The dealer felt it should be covered by their hands are tied. I find that Tecumseh was purchased by Certified Parts Corporation out of Janesville WI. The 800 # they called was 800-364-7938 and it was that number that the warranty was denied. Does anyone know who else I can contact to try and settle this. I WILL file a small claims suit on this but It would be more cost effective for this new company to just pay for the repairs under warranty.

    My lawnmower was a John Deere. I bent the crankshaft and discarded the mower three years ago. I still have the original paper work which was submitted with the claim and includes the serial number but not the engine serial number. The dealer does not have that in his records either. Any ideas on how to get this info that the settlement claims administrator is now requiring.

    I got the same letter about the engine id. What can I do? I don't think there is such a number

    which line of numbers is considered the engine id number? i have three lines ; model, type and code. which do they want? this is off a husqvarna riding mower with a b & s engine.

    I am part of this Class Action Law Suite and received a check and papers claiming I have an extended warrenty. The problem is I accidently threw it away, is there any place I can go on line to get a new copy issued?

    I was able to seek a settlement on a push mower and I also have a Allison Chambers riding mower and I sent a number that I thought was the motor number, I received a letter saying that was not correct. We have recently found the motor number it is 44L777. I would like for the number to be added to my claim.

    I received a letter in October 2011 asking me to recheck the motor number on my John Deere riding mower & fill in information which I did & returned via mail 10/30/2011. I have never received a check from them & I know from the listings that my mower was included in this suit. How do I proceed to recieve my refund

    We filled out the claim form – got the numbers from the motor just like it said and sent copies of the sales receipts and still got a letter saying they need more numbers. What a scam. Did anyone ever receive a settlement?

    We did not receive correspondence regarding the final law suit for the mowers we have purchased during the time period specified. We didn't receive and monetary compensation from the law suit. Does this mean we did not qualify? We purchased a 16 horsepower and a 22 horsepower riding mower from Toro. We filed providing necessary information timely.
    A response would be appreciated.

    I have a Kohler Courage 20 that came in a Cub Cadet riding mower. After only about 126 operating hours the block cracked and blew the oil out. Kohler has offered to replace the block, but they won't send it directly to me. It has to go to one of their authorized repair shops, and I have to pay for the repair labor, which will come to just under a THIRD of what I paid for the machine! (I wonder if any of that goes back to Kohler to cover the block?…that would be of interest to a law firm wouldn't it?) Anyway, getting such a poorly designed motor repaired for that price would be throwing good money after bad. I did a little internet searching, and I have discovered that I am far from the only one with an experience like this with Kohler engines. If any attorney is motivated to pursue a class-action suit on this matter, sign me up!
