Zimmer Holdings, the manufacturer of medical devices, has cut loose its long-time consultant, Dr. Richard A. Berger, after his reports that Zimmer’s mechanical knee replacement is prone to failure. He could’ve been a whistleblower. Instead he complained to Zimmer and his next year’s contract has not been renewed.
I wonder what would have happened if he first complained to the federal government and the FDA—which is typically the first action to take if a whistleblower plans to file a qui tam lawsuit ( claims against pharmaceutical companies are becoming almost commonplace). Second, you find a good attorney.
Getting back to the good doctor. It’s not like he needed the money: according to the New York Times, Zimmer portrayed Dr. Berger as a master surgeon and paid him more than $8 million over a decade. On his website, Dr. Berger freely admits that he “receives royalties and payments from the manufacturers of these devices”.
But in 2005, Dr. Berger implanted Zimmer’s NexGen CR-Flex device in about 125 patients and within about a year, x-rays showed that the device was loose and had not fused completely. Patients were in pain, apparently because of the loose joint. Dr. Berger did his due diligence and reported the problems to the maker.
Here’s the crunch: the FDA never required Zimmer to study the device in patients before selling it. Zimmer dismissed the doctor, saying it was his technique to blame and not a manufacturing defect. Dr. Berger told the Times that other surgeons were soon reporting similar problems.
In the Times article, experts cited that the falling out between Dr. Berger and Zimmer highlights the lack of independent, unbiased information about orthopedic implants, since there is no system of tracking the performance of artificial hips and knees in the US.
Whisteblowers have file qui tam lawsuits against several medical device companies, alleging improper marketing when the products were sold off-label, which resulted in Medicare paying excessive reimbursements. If successful, these suits can reimburse the government big time. But what would happen if a whistleblower came forward in the case of the Zimmer knee replacement, when the FDA didn’t require any controls, nor clinical trials? It would seem that someone should blow the whistle on the FDA…
i had orthoscopic on my knee, short time after had a zimmer space. short time after it shot out the side, emerg. surgery to remove so i could walk. next zimmer rep was at the operating table with my Dr and i had the biggest spacer they make put in, that too came out in short order, then i had a zimmer total knee, it was messed up from the start and maybe a year or less it needed revision, wow a year later is worse then never and the blood clott is gone but i have drop foot and keep falling, my knee buckles, gives out and lockes up. my wife has to help me walk cuse i keep falling. hope it doesnt brake off from falling, sorry i ever had it done as i am worse off and my life has changed from it.
My L knee is in Abject PAIN and has been for 4 years…since the last surgery! I spent a lot of time researching who to do these last 2 and Dr. Piement in Los Angeles did it , I wouldn’t (could not) suggest him to slice beef! It has never healed. I still look for that well respected surgeon??
I too had a Zimmer knee installed by The VA in Palo Alto Oct 28th 2010, and have been in severe pain ever since. I have fallen and may have cracked other bones due to this? The surgeon say;"it's perfect", but I know what perfect and this is not perfect! I've had several knee operations on the same knee and would never have had this one if I knew it was going to feel like it's just lose and not attached even 3 inches south of the knee! What is even worse yet, is the fact that the VA disagrees what is wrong! The bone scan indicates it is lose? The doctor says it's "perfect" So they do nothing, and I'm on morphine and can't drive to any medical or dental appointments living in the country. Pain is intolerable!!
I called Zimmer to see if they would help me, they seem nice and appologetic and are sending me a form to allow them to get my record of the surgery. But The VA is just heartless in this matter and won't even send me to a local doctor. I blame the VA more than Zimmer just because they are at least kind when there is obviously something very bad wrongg with my knee! Zimmer makes a knee with a longer extension which is made for this exact purpose. I have a legal firm looking into seeing if the knee pieces are on their recall list? I have the info, but find it hard to understand it. But I understand common sense, and that is my knee is now in much worse shape than it ever has been. I wish I had not opted for VA "Healthcare!" I really believe The VA wants as many dead Vets as they can help that to be! 50% suicide rates on returning combat Vets! That is why the Army uses the same men over and over, even with PTSD known to be evident! All for money, not the Veteran's benefit! I'm very mad at The VA!!
