State of California and R & R Labor Service
Central Valley - At the age of 24, Constantino Cruz Hernandez was working for farm labor contractor R & R Labor Service in a tomato field in California. On July 21, 2005 the father of two fell ill after machinery in the field was moving too quickly, causing laborers to work at a fast pace in temperatures over 100 degrees. Hernandez was admitted to Kern Medical Center, but was released the next day. While at home he collapsed and his heart stopped. Ten days later he was pronounced dead at a Delano hospital. He died due to exposure to extreme heat. Hernandez's wife and two children filed a workers compensation lawsuit against the company. The Californian State Compensation Insurance Fund has agreed to pay the two children $448 every two weeks until the youngest child reaches 18. According to the United Farm Workers of America they will receive more than $180,000 total. (Oct-06-06)
