Merck & Co. Class Action Rejected
This is a settlement for the Drugs/Medical Devices lawsuit.
New Orleans, LA: Thousands of federal lawsuits claiming the drug Vioxx caused heart attacks and other conditions that killed or injured people were seeking national class action status. US District Court Judge Eldon Fallon rejected the plaintiffs' proposal to try all of the cases under the laws in New Jersey, Merck's US headquarters. Fallon did not rule on the possibility of separate state class actions. The judge rejected the national class action noting plaintiffs in other states could not reasonably expect their personal injury claims to be governed by New Jersey law. (Nov-22-06)
