York County, NY and Pleasant Acres Nursing & Rehabilitation Center
This is a settlement for the Wrongful Termination lawsuit.
York County, NY: (Jul-12-07) John Herbst Jr. brought a federal lawsuit against Pleasant Acres Nursing & Rehabilitation Center and York County alleging that he was wrongfully fired for reporting allegedly hazardous levels of asbestos in the buildings' flooring. Herbst was hired in November 2002 as a carpenter at the nursing home, where part of his job was to remove floor tiles from the home.
In a settlement reached, York County agreed to pay Herbst $150,000 to settle the charges. Under the settlement reached, the county and the employees named in the lawsuit admit no liability for wrongdoing. It agreed to clear Herbst's disciplinary record and give him a neutral job reference. Herbst, however, maintains the ability to make a claim against the county for asbestos-related illness due to his time working at the nursing home.
