Nassau County, NY
Nassau County, NY: (Jul-26-07) The US Equal Employment Opportunity Commission brought charges against Nassau County, accusing it of violating federal anti-age discrimination laws when it transferred four police Marine Bureau officers over the age of 50 to lower paying, less prestigious positions in July 2006. The four officers, Lawrence Coleman, Arthur D'Alessandro, Robert Macaulay, and Joseph Petrella, claimed that the county's decision to transfer them and replace them with younger employees was part of an effort to force them to retire.
In a settlement reached, the Equal Employment Opportunity Commission is proposing the county pay the officers $450,000 total to cover one year's worth of damages, as well as attorney fees, to settle the charges or face a federal lawsuit. The federal agency further stated that the damages will increase if the county does not agree to the proposed settlement, which also demands that Nassau require its managers and supervisors to attend eight hours of classroom training, and all county employees to attend four hours of training about the federal Age Discrimination in Employment Act.
