Riverside, CA: (Aug-17-07) The US Equal Employment Opportunity Commission (EEOC) brought a lawsuit against Riverside-based Sierra Aluminum Co., alleging that the company fired Rosa Suarez after she alerted management that her boss was viewing online pornography at work. The EEOC filed the suit on behalf of Suarez, 48, of Rialto. She claimed that she had worked for the company for six years when she was fired. Suarez claimed that she saw her direct supervisor viewing pornography twice in July and August of 2004. Some of the pictures were of naked women; others were of naked men and women together. Several other people in the office also were able to see the supervisor's computer screen and attested to the allegations. Rosa informed the company's human resources department and the supervisor's boss in September 2004. She was told that they would investigate, but she found her services terminated 11 days later.
In a settlement reached, Sierra Aluminum agreed to pay the former employee $200,000 to resolve the suit. As part of the settlement, detailed in a settlement consent filing signed by both sides, the company has agreed to retain an Equal Employment Opportunity Commission consultant and have supervisors participate in sexual harassment prevention training.
