Buffalo, NY: (Aug-22-07) Mark Pasternak brought a lawsuit against the state of New York alleging that he faced racial discrimination in his workplace. The suit claimed Pasternak, who is white, was dismissed from his state job helping troubled youths because he could not tolerate being called names like "cracker," "polack" and "stupid white boy." Pasternak named Tommy Baines, the supervisor, as being one of the principal defendants. Pasternak's attorney said his client took abuse from Baines for three years while the two men worked with an agency formerly known as the state Division for Youth. The facility is no longer in operation.
In a settlement reached, a seven-member all-white jury found that Tommy Baines, who is black, discriminated against Pasternak and created a hostile work environment.
