Hooters
Henrietta, NY: (Aug-24-07) The US Equal Employment Opportunity Commission (EEOC), filed suit against the Hooters bar and restaurant in Henrietta, on behalf of Melissa Vicari-Broccolo. Vicari-Broccolo, a longtime employee who had multiple sclerosis, claimed that she faced disability discrimination while she worked at the restaurant. Vicari-Broccolo, 32, of Penfield started working at Hooters in 1998. She was diagnosed in 2003 with MS, a degenerative disease of the central nervous system. MS symptoms include fatigue and inability to walk. The EEOC said the restaurant violated the Americans with Disabilities Act by failing to provide reasonable accommodation to Vicari-Broccolo.
In a settlement reached, the restaurant agreed to pay the waitress $75,000 to resolve the allegations and end litigation. In a statement released in 2006 in response to the lawsuit, the restaurant chain said that it made every reasonable accommodation available for the employee. Vicari-Broccolo has been out of work since she quit in 2004. She said she believes the settlement is beneficial to both parties. [DEMOCRAT AND CHRONICLE: DISABILITY DISCRIMINATION]
