Carbon County, PA: (Dec-03-07) Robert Yurchak, former chief public defender, brought charges against Carbon County, alleging that he was wrongfully terminated. Yurchak, who had worked with the public defender's office for about 20 years, including six spent as the chief public defender, filed the suit almost six years ago saying he was wrongfully fired. He sought more than $1 million, claiming that he suffered anxiety, distress and embarrassment as a result of his being fired. In a pretrial memorandum, Yurchak said he suffered economic damages of $1.05 million to $1.34 million. He also said he suffered mentally and emotionally and that added to the compensatory damages.
He sought punitive compensation from Carbon County, retired commissioner Thomas Gerhard, and current Commissioner Wayne Nothstein, who after firing Yurchak, voted to promote everyone in the public defender's office one spot, giving Republican Gregory Mousseau the top job. Yurchak filed the suit days after he was fired. He also sought an injunction to get his job back but later dropped the request. As part of a settlement reached, Carbon County agreed to pay Yurchak $525,000 to resolve the lawsuit. [STANDARD SPEAKER: PUBLIC DEFENDER FIRED]
