Employee Age Discrimination
Lehigh County, PA: (Dec-27-07) The US Equal Employment Opportunity Commission (EEOC) brought a lawsuit against Hannabery Electric of Upper Macungie Township, alleging that the company systematically fired older workers. The lawsuit, filed by the EEOC in October 2006, claimed the company retaliated against several workers after they complained about age discrimination by taking away raises, bonuses and benefits. Records show that Gary Hall, 71, filed an age discrimination charge with the EEOC alleging that Hannabery violated the Age Discrimination and Employment Act, which prohibits discrimination against workers over 40 years old, after learning that management ordered another employee to spy on him. Hall, who worked in customer service at Hannabery, was demoted to work in a warehouse in Quakertown after he filed the charge with the EEOC. The suit further stated that several other employees, all over 50, were later fired.
As part of a settlement reached, the local company agreed to pay $156,000 to settle the age discrimination lawsuit. Additionally, the company agreed to a five-year consent decree that requires the company to provide mandatory training for all supervisors and managers on prohibitions against discriminating against employees because of age.
