Injured Immigrant Worker
Providence, RI: (Jan-14-08) Edgar Velásquez, an illegal Mexican immigrant, brought a personal injury claim against William Gorman Jr., owner of Billy G's Tree Care, after he accidentally slashed his face open with a chainsaw in 2006. The suit stated that Velásquez was working for Gorman Jr., and that Billy G's Tree Care hired the 22-year-old Velásquez, and then turned his back after Velásquez sustained the severe injury. Velásquez claimed that Gorman tipped off immigration authorities, who arrested and deported him before he could pursue his rightful claim under state law. Last fall, one year after his deportation, the US Department of Homeland Security granted Velásquez a rare humanitarian visa that allowed him back into the country to face Gorman in court.
As part of a settlement reached, Edgar Velásquez won a $30,000 payout from Gorman Jr., resolving the personal injury suit. Chief Workers' Compensation Judge George Healey Jr. stated that the settlement should put employers on notice. [PROVIDENCE JOURNAL: INJURED WORKER]
