Palm Beach, FL: (Jan-15-08) Jerry Smith, 36, a former school district police officer, brought charges against the Palm Beach County School, alleging that he was wrongly fired during his probationary period. The suit claimed that Smith worked from May to December 2002 at William T. Dwyer High School in Palm Beach Gardens and was not told why he was fired. During the proceedings, the school board stated that the termination came after Smith made inappropriate comments to a student. Smith stated that in April 2003, he refused a job with the Riviera Beach police, for whom he previously had been an officer for eight years. He later looked through his school district file and found out about the accusations.
Smith requested a hearing to clear his name and that the blemish is stricken. A judge denied the request to have the allegations deleted from his personnel file, but granted him $60,300 in damages. Records show that Smith appealed the case to the 4th District Court of Appeal in West Palm Beach to cover legal fees and costs.
