Tanning Salon Defamation
Duluth, MN: (Jan-21-08) Franklin Curtiss, owner of two Baja Tanning salons, brought a lawsuit against WDIO-TV, alleging that the television station made false statements about him on its news broadcasts and web site in February, May, June, and September of 2005. The suit stated that WDIO-TV defamed him in its reporting after he was charged with videotaping three female customers without their knowledge. Records show that Curtiss' stepdaughter filed a lawsuit against him in March of 2005 alleging that Curtiss videotaped her and two other women customers in various stages of undress. The suit stated that Curtiss invaded her privacy and she suffered serious mental and emotional distress. In connection with the woman's allegations, Curtiss was also charged with the misdemeanor crime of interference with privacy.
In March 2006, a St. Louis County jury dismissed the women's claims and cleared Curtiss of any wrongdoing in the civil case. A day later, the criminal charge against him also was dismissed. Curtiss then filed suit, claiming that WDIO anchorman Dennis Anderson and former station reporter Margaret Clevenstine made false statements in their reporting that resulted in harm to his business and reputation in the community. Sources close to the case stated that the two sides reached an undisclosed settlement, resolving the long-standing dispute. [DULUTH NEWS TRIBUNE: BUSINESS DEFAMATION]
