Police Chief Resignation
Lyndeborough, NH: (Feb-27-08) Former Police Chief James Basinas brought charges against the town of Lyndeborough, over the Chief's resignation from his position with the city's police department. The suit stemmed from a Basinas's being placed on paid administrative leave in February 2007. According to town officials, the action was taken against the chief for allegedly failing to follow a number of administrative processes and not providing adequate police coverage of the town. After providing Chief Basinas with the opportunity to respond to these allegations, the board terminated his employment in April 2007. Basinas then sued.
Court records show that Hillsborough County Superior Court Judge James Barry ruled that the town had failed to show substantial cause in terminating Basinas and ordered the chief reinstated in October 2007. Basinas remained on administrative leave until the town's appeal of the judge's decision could be decided. Due to confusion over the logistics of the court case, Barry reversed his decision until a full trial could be conducted. His order to reinstate Basinas stood, however, and he returned to work on Nov. 16, 2007. In a recent development, the Board of Selectmen agreed to a final settlement with Basinas, agreeing to pay him a cash payment of $23,500 and $30,000 in legal fees.
