Palm Springs, CA: (May-08-08) Five farm workers brought a lawsuit against Mecca-based Richard Bagdasarian Inc., a local grape grower, over health and safety laws. The July 2002 lawsuit stated that the grape grower forced workers to eat grapes to test for sweetness. They also accused him of requiring employees to work through rest and meal breaks. The suit originally sought $1 million in back pay and penalties. In its defense, the grower said that the company did not require the tasting and the employees had consented of their own accord to work a shorter schedule, so that they could spend less time in the desert sun.
Sources stated that the two sides reached a settlement agreement in the dispute, in which Richard Bagdasarian Inc. agreed to a $585,000 payout. The settlement includes separate $7,500 payments to the five plaintiffs, who brought the lawsuit. They include Maria Leticia Banda, Maria Eva Estrada, Jose Banda, Cecilio Banda and Mercedes Ramirez Moreno. The settlement also stipulated the establishment of a $447,500 fund to be distributed among farm workers who worked for Bagdasarian between 2001 and 2002.
